A Federal High Court in Abuja has scheduled October 30 to hear the preliminary objection presented by Ondo Governor Rotimi Akeredolu in response to a suit filed by his deputy, Lucky Aiyedatiwa.

Aiyedatiwa’s suit aims to prevent his impeachment by the Ondo State House of Assembly.

The judge, Justice Emeka Nwite, also fixed the same date for the hearing of the deputy governor’s counter affidavit, the Ondo State House of Assembly’s jurisdiction-challenging application.

And a motion for the stay of execution of the court’s interim order, filed by the lawmakers.

Justice Nwite instructed all parties to ensure the Inspector-General of Police and the Department of State Service are served with the necessary documents ahead of the upcoming proceedings.

his legal battle originated from an interim order issued by Justice Nwite on September 26, which restrained the Ondo State House of Assembly from pursuing Aiyedatiwa’s impeachment.

Akeredolu was also barred from nominating a new deputy governor, pending the resolution of the interlocutory application, in light of doubts surrounding Aiyedatiwa’s purported resignation.

Aiyedatiwa’s lawsuit against the Inspector-General of Police and the Department of State Service, as well as other relevant parties, seeks to protect his position.
