Just In : Court bars Ondo govt from installing monarch
An Ondo High Court sitting in Akure has barred the Ondo State Government from approving, announcing and recognising Chief J. K. Ajomole as the Ojogbabiaka of Ilado community in Akure North Local Government.
The Ojogbabiaka of Ilado was among the 62 chieftaincy stools that were recently upgraded and elevated by Governor Oluwarotimi Akeredolu
Chief Ifedayo Afelumo had approached the court to declare him the authentic and legally recognised Olu of Ilado to occupy the elevated stool of Ojogbabiaka of Ilado.
He also asked the court to bar the Ondo State Government from recognising or approving Chief Kayode Ajomole as Ojogbabiaka of Ilado.
Ruling, Justice A. O. Adebusoye said it was a situation where the court should exercise its discretion in favour of the applicants.
“Consequently, this application succeeds in part and leave is hereby granted the applicant to apply for an order of prohibition preventing the 2nd-4th Respondents from approving, announcing and recognizing the 1st Respondent as the Oba Ojogbabiaka of Ilado.
“This order now granted should operate as a stay restraining the 2nd – 4th Respondents from approving, announcing and recognizing the 1st Respondent as the Oba Ojogbabiaka of Ilado pending the hearing of the substantive application”.
Leadership crisis had rocked Ilado community after the Deji of Akure, Oba Aladelusi Aladetoyinbo, removed Chief Ajomole and appointed Chief Afelumo.
Oba Aladetoyinbo said he removed Chief Ajomole based on his the traditional and legal powers to appoint minor chiefs, Olus and Baales in both Akure South and Akure North local government areas and as paramount ruler of the kingdom.
