Court Strikes Out PDP’s Suit Seeking To Stop the Constitution of LG Interim Management Committee in Ondo state

An Ondo High Court sitting in Akure presided over by Justice A. A. Fasanmi has dismissed a suit filed by the Peoples Democratic Party( PDP) seeking an injunction to restrain the Ondo state government from nominating, selecting or appointing a person or group of persons not democratically elected to administer the affairs of Local Government Councils and Local Council Development Areas in the state.

At the resume sitting on Wednesday 15th May, counsel to the PDP moved a notice of discontinuance filed on the 13th May, 2024, which was not opposed by the counsel to the 1st and 4th Defendants, Ebun Olu Adegboruwa SAN represented by Allen Sowore, Esq .

However, the defence counsel to the 2nd and 3rd Defendants, Femi Emodamori opposed the wordings of the notice which he observed would rob the statutory role of his client of sanctioning the decision of the 1st Defendant in that regard.

The Court observed that although the claimant was at liberty to discontinue his matter at any stage, such an application shouldn’t impose duties and responsibilities on parties.

Awofade thereafter moved the motion orally in accordance with Order 5 rule 37 of the State Civil Procedure Rule to which no party objected. Accordingly, the court struck out the matter. The matter was discontinued forthwith.
