The Presidential Election Petitions Court has denied President Bola Ahmed Tinubu’s and the All Progressives Congress’ (APC’s) applications to dismiss the Allied People’s Movement’s (APM’s) petition challenging the February 25 presidential election.

On Monday, a five-member panel presided over by Justice Haruna Tsammani ruled that dismissing the petition would violate the principle of fair hearing against the party.

 

The petition was filed by APM and its presidential candidate, Chichi Ojei, on the sole basis of Tinubu’s ineligibility to run in the election due to the alleged double nomination of his running mate, Kashim Shettima.

 

However, Tinubu’s lead counsel, Wole Olanipekun (SAN), cited a Supreme Court decision on May 26 in a related suit filed by the PDP, which dismissed the suit on the grounds of lack of locus standi.
